By accessing or using our website or services, or by opting in to receive text messages from us, you agree to be bound by these Terms. If you disagree with any part of these Terms, do not use our website or services.

Description of Services

Buzzkillerz is a Colleyville, Texas lawn and pest control company that provides Texas-licensed lawn treatment and structural pest control services to residential properties. Treatments are performed under the applicable Texas Department of Agriculture and Texas Department of Licensing and Regulation licensing. Nothing on this website constitutes legal or financial advice.

Eligibility

You must be at least 18 years old and either the legal owner of the property you submit, or someone authorized to request service for that property. By using our services, you represent that you meet these requirements.

User Content

Our services allow you to submit information about yourself and your property — including text, photos, and documents ("Content"). You are responsible for the Content you submit, including its legality and accuracy. By submitting Content, you grant us a non-exclusive, royalty-free license to use it for the purpose of evaluating your property and communicating with you.

SMS / Text Messaging Program

When you provide your mobile number and opt in (for example, by checking a consent box on a form, or by texting us first), you agree to the following terms governing our text-messaging program.

Program Description

The Buzzkillerz SMS Program sends transactional and customer-service messages related to your inquiry and service, including scheduling, follow-ups, treatment details, and status updates.

Message Frequency

Message frequency varies based on your interaction with us. A typical inquiry generates between 2 and 10 messages.

Message and Data Rates

Message and data rates may apply for messages sent to and from us. Check with your wireless carrier for the details of your plan.

Opt Out (STOP)

You can cancel the SMS service at any time by texting STOP to the number from which you received our message. After you send STOP, we will send a single confirmation message. You will not receive further messages unless you opt back in.

Carrier Liability

Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your wireless carrier and is outside our control.

Privacy

Information collected through the SMS program is governed by our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Opt-in data and consent are not shared with any third parties, other than the subprocessors strictly required to deliver the messages.

Standards and Legal Compliance

Our messaging program complies with applicable law, including the Telephone Consumer Protection Act (TCPA). By opting in, you confirm that you are the subscriber or customary user of the wireless number you provide, and that you consent to receive autodialed and pre-recorded informational messages at that number. Consent is not a condition of receiving service.

Disclaimers and No Warranty

Our website and services are provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or secure. Any estimate or quote provided through the site is not final or binding until reduced to a signed service agreement.

Limitation of Liability

To the maximum extent permitted by law, Buzzkillerz LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the website or services. Our total liability for any direct damages will not exceed the greater of (a) one hundred U.S. dollars (USD $100) or (b) the amount you have paid us, if any, in the twelve months preceding the claim.

You agree to indemnify and hold harmless Buzzkillerz LLC from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the website or services, or your violation of any law or third-party right.

Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of our services will be brought exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the personal jurisdiction of those courts.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide reasonable notice prior to the new terms taking effect. By continuing to use our website or services after a revision takes effect, you agree to be bound by the updated Terms.
